Welcome to Elaré Studio. These Terms of Service govern your use of elarestudio.com and purchases from us. By using our site or placing an order, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use our site.

Eligibility

You must be at least 18 years old, or have the consent of a parent or legal guardian, to place an order with us.

Your Account

If you create an account, you are responsible for keeping your login details confidential and for all activity under your account. Please email hello@elarestudio.com promptly if you believe your account has been used without permission.

Product Descriptions and Imagery

We make every effort to display our pieces accurately. Colours and finishes may appear differently depending on your screen.

Natural materials, including freshwater pearls, mother of pearl, malachite, lapis lazuli, and tiger eye, vary in colour, pattern, and inclusion from piece to piece. This variation is inherent to natural materials and is not considered a defect.

Materials and Care

All sterling silver pieces are S925. Plated finishes may wear over time with regular use; this is normal wear and is not covered as a defect. Our pieces are not designed to be worn while swimming, bathing, exercising, or while using cosmetics, perfumes, or cleaning chemicals. Damage resulting from such use is not covered by our return policy.

Pricing and Availability

All prices are in U.S. dollars and may change without notice. Applicable sales tax is calculated at checkout. We make every effort to ensure pricing is accurate; if an error occurs, we may cancel the affected order and issue a full refund.

Orders

Your order is an offer to purchase. Receipt of an order confirmation does not constitute our acceptance of your order. We may refuse, limit, or cancel an order for reasons including suspected fraud, reseller activity, product availability, or an error in product information or pricing. If we cancel an order after payment has been taken, we will issue a full refund to the original payment method.

Promotions and Discounts

Promotional offers, discount codes, and free-shipping thresholds may change or end at any time. Promotions may not be combined unless we expressly state otherwise. The terms in effect when an order is placed apply to that order.

Shipping and Returns

Delivery estimates, shipping rates, and tracking information are set out in our Shipping Policy. Return eligibility, cancellations, and refund timing are set out in our Refund Policy. Those policies form part of these Terms.

Reviews and Submitted Content

If you submit a review, photograph, or other content, you grant Elaré Studio a non-exclusive, royalty-free, worldwide licence to use, reproduce, and display that content in connection with our business and marketing. You confirm that the content is your own and does not infringe another person's rights. We may remove content that is unlawful, offensive, misleading, or otherwise inappropriate.

Intellectual Property

All content on this site, including product photography, text, designs, graphics, and the Elaré Studio name and logo, is owned by us or our licensors and is protected by intellectual-property law. You may not reproduce, distribute, or use it commercially without our written permission.

Prohibited Uses

You may not use our site to break any law, infringe intellectual-property rights, transmit malicious code, scrape or harvest data, interfere with site security or operation, or purchase products for unauthorised resale.

Third-Party Links

Our site may link to third-party websites or services. We are not responsible for their content, products, or privacy practices.

Disclaimer and Limitation of Liability

Our site and products are provided “as is” and “as available” to the fullest extent permitted by law. We do not warrant that the site will be uninterrupted, secure, or error-free. To the fullest extent permitted by law, Elaré Studio will not be liable for indirect, incidental, special, consequential, punitive, or similar damages. Our total liability for a claim relating to an order will not exceed the amount paid for that order. Some jurisdictions do not allow certain limitations, so some of these limitations may not apply to you.

You agree to indemnify and hold harmless Elaré Studio and its officers, employees, and partners from claims or demands arising from your breach of these Terms or violation of law or a third party's rights.

Governing Law and Disputes

These Terms are governed by the laws of the State of Texas, United States, without regard to conflict-of-law principles. Any dispute will be brought exclusively in the state or federal courts located in Collin County, Texas, and you consent to their jurisdiction.

Changes and Severability

We may update these Terms from time to time. Continued use of the site after revised Terms are posted constitutes acceptance of them. If any provision is found unenforceable, the remaining provisions remain in effect.
